NATOA Files Appellate Brief
In a brief filed July 18, NATOA, along with NLC, NACo, USCM, ACM, and ACD urged the United States Court of Appeals for the Sixth Circuit to overturn the FCC’s video franchising Order. The coalition asserts that the FCC had no statutory authority, acted in an arbitrary and capricious manner, and violated public notice requirements when it issued its Order. Briefs were also filed on behalf of the City of Tampa and other communities; the City of New York; Fairfax County, VA; NCTA; New Jersey Rate Payer Advocate; and the City and County of San Francisco. In addition, two amicus briefs were filed, one on behalf of a coalition of local governments and associations and the other on behalf of PEG non-profit corporations.
