NATOA and NYC File Brief Challenging FCC Small Cell Orders

On June 17, 2019, NATOA and New York City filed a joint intervenor brief in the 9th Circuit Court of Appeals challenging the FCC's 2018 rules preempting local authority over siting of small wireless facilities. The brief supplements the outstanding briefs filed by a large group of local governments and municipal organizations, the American Public Power Association and Montgomery County, Maryland.

The case will be fully briefed by early September with a decision from the 9th Circuit possibly in the first half of 2020, but the Court does not have a specific period of time in which to issue the decision.
